Terms of Participation and the Liability Waiver for "The Sun & Light " (31.7.26 to 2.8.26)
1. Independent Services & Accommodation: Five Senses Retreats (the "Organizer", "we", "us", "our"), acts as a facilitator for retreat programming only. While the total price, including accommodation at Haltia Lake Lodge is provided for the convenience of the Participant (or "you", "your"), the actual accommodation costs are separate from the retreat program fee of €899. Any booking made with Haltia Lake Lodge or other providers is a direct contract between the Participant and the accommodation provider. The Organizer is not responsible for, and shall not be liable for, any disputes, injuries, property damage, or dissatisfaction arising from the accommodation services.
2. Food, Allergies, and Dietary Requirements: While the Organizer coordinates with third-party catering and restaurants to accommodate disclosed dietary needs, the Participant acknowledges that food is prepared in facilities that handle common allergens (nuts, gluten, dairy, etc.). The Organizer is not liable for any allergic reactions, food-borne illnesses, or dietary mishaps. It is the Participant's responsibility to carry necessary medication (e.g., EpiPens) and to verify ingredients with servers at each meal.
3. Assumption of Risk: The Participant acknowledges that activities take place in a natural forest environment (Nuuksio National Park) and involve inherent risks, including but not limited to: uneven terrain, weather changes, and local flora/fauna. Participation in the Finnish sauna and cold plunge involves extreme temperature changes. The Participant assumes all risks associated with these activities.
4. Limitation of Liability: To the fullest extent permitted by law, the Organizer shall not be liable for any injury, property damage, theft, or financial loss, except in cases of proven gross negligence or willful misconduct by the Organizer. The Organizer’s total liability for any claim shall be limited to the amount paid by the Participant for the retreat program.
5. Compulsory Insurance: The Participant is strictly required to maintain personal travel, medical, and accident insurance for the duration of the retreat. The Organizer is not responsible for any costs related to medical evacuation, trip interruption, or emergency care.
6. Everyman’s Right & Conduct: Participants must adhere to the Finnish "Everyman’s Right" (Jokamiehenoikeus) and National Park regulations. The Organizer reserves the right to remove any Participant from the program (without refund) whose behavior is deemed dangerous or significantly disruptive to the group.
7. Force Majeure: The Organizer is not liable for failures due to causes beyond reasonable control (e.g., extreme weather, government restrictions that make it unreasonably difficult to hold the retreat).
8. Organizer's Right to Cancel: If the Organizer cancels the retreat voluntarily (e.g., low enrollment), a full refund of the participation payment minus any processing fees will be provided. If forced to cancel due to factors beyond the Organizer's control—such as force majeure, extreme cost spikes, or sudden venue or service provider cancellation—the Organizer will refund the payment minus any processing fees and unrecoverable vendor costs already paid. The Organizer is never liable for a participant's personal travel expenses (flights, transit, etc.). Purchasing travel insurance is strongly recommended.
9. Schedule Flexibility: The Organizer reserves the right to make reasonable changes to the itinerary, workshops, or partners due to weather, logistics, or unforeseen circumstances. Such adjustments will maintain the overall value of the retreat and do not entitle participants to a refund.
10. Photo Release: The Participant grants permission for photos/videos taken during the retreat to be used for promotional purposes unless the Participant notifies the Organizer in writing indicating otherwise prior to the usage of the photos or videos.
